无效行政行为是从大陆法系国家引入的具有特定涵义的概念,其存在的理论基础是行政法治原则、行政抵抗权和有限公定力原理。无效行政行为的判断标准有一般标准和具体标准。我国应完善无效行政行为的制度设计。

The concept of invalid administrative action is a concept introduced from countries of mainland legal system with particular connotations. Its theoretic foundation lies in the administrative and legal principle, the administrative resistance right and the principle of limited presumptive legality.
